Customers using CVI's Reference and Background Investigation Services must sign User Service Agreements that confirm their understanding of the same laws and regulations noted above as well as communications and processing obligations required when utilizing a third party to gather consumer reports.
All employers should be aware that Virginia provides a qualified immunity to employers that provide certain employment references on current or former employees. The law grants a limited immunity from civil liability to an employer who discloses information about a current or former employee's job history or job performance to a prospective employer of the current or former employee. Additionally, employers who fail to give out employment references could face civil liability for the future actions of their former employees.
